深潮 TechFlow 消息，9 月 16 日，据 CoinDesk 报道，美国《Clarity 法案》在参议院表决中未能跨越 60 票的终结辩论门槛。针对此次立法受挫，Enso、tZERO 及 Cardano Foundation 等项目方高管认为，投票结果并未逆转向合规数字资产市场转型的结构性趋势，SEC 与 CFTC 亦已在各自职权内推进相关框架。但多名负责人指出，行政机构规章缺乏法案级别的持久性，极易随政府更迭被改写。随着参议院 10 月进入休会期及 11 月初大选临近，若下一届国会仍无法推动明确立法，企业将持续面临规则碎片化难题，倒逼资本与开发团队流向已实施 MiCA 制度的欧洲市场。

Executives at Enso, tZERO and the Cardano Foundation said the vote doesn't reverse the structural shift toward regulated digital asset markets, and the SEC and CFTC are already advancing frameworks within their authority. But several noted administrative rules lack the durability of statute and can easily be rewritten with a change of government. With the Senate in recess in October and elections in early November, if the next Congress still can't pass clear legislation, companies will keep facing fragmented rules, pushing capital and developer teams toward Europe's MiCA regime.
